Welcome to Bacon & Bygones! The terms "we", "us" and "our" refer to Bacon & Bygones LLC. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"), to give you, the customer, a curated shopping experience. Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the "Terms") describe your rights and responsibilities when using the Services. Please read them carefully. By placing an order, you agree to these Terms, including our Refund Policy and Shipping Policy. Our Privacy Policy explains how we handle your information. We currently sell and ship to addresses in the United States only.

2. Our products

All products are printed on demand by our fulfillment partner. We try to display product colors, images, and details as accurately as possible, but colors may vary by screen, and printed colors on fabric or ceramic may differ slightly from on-screen images. Product descriptions are provided for information; humor and designs are intended as jokes and do not constitute advice of any kind, including medical, nutritional, or dietary advice.

3. Orders

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order, or to cancel an order, for example if a product is unavailable, if there is an error in pricing or product information, or if we suspect fraud. If we cancel an order after you've been charged, we will refund the amount charged.

4. Prices and billing

Prices, discounts, and promotions are subject to change without notice. Prices shown do not include taxes and shipping, which are calculated and shown at checkout. You agree to provide current, complete, and accurate purchase and payment information.

6. Intellectual property

The Services and all designs, text, graphics, and other content on them are owned by us or our licensors and are protected by copyright, trademark, and other laws. Purchasing a product does not grant you any rights in the design printed on it beyond personal use of that product.

The Services may contain links to third-party websites or rely on third-party services (such as Shopify, payment processors, Printful, and shipping carriers). We are not responsible for third-party content, policies, or practices.

8. User content and feedback

If you send us comments, ideas, reviews, or other feedback, you grant us a non-exclusive, royalty-free right to use it without obligation to you. You agree not to submit anything unlawful, infringing, or harmful.

9. Prohibited uses

You may not use the Services for any unlawful purpose; to infringe anyone's rights; to upload malicious code; to collect others' personal information; to interfere with the security or operation of the Services; or to scrape, spam, or phish.

Our products come with the Limited Warranty in our Refund Policy. To the extent permitted by law, the website itself is provided "as is." Nothing in these Terms excludes or limits any warranty or right that applicable law gives you as a consumer and that cannot be waived, including implied warranties under state law.

To the fullest extent permitted by law, Bacon & Bygones LLC and its members, employees, and service providers will not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Services or any product. Our total liability for any claim related to a product will not exceed the amount you paid for that product. This section does not limit liability for death or personal injury caused by our negligence, for fraud or intentional misconduct, or for anything else that cannot be limited under applicable law. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

To the extent permitted by law, you agree to indemnify and hold us harmless from claims arising out of your breach of these Terms or your violation of any law or the rights of a third party.

These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of any mandatory laws of the state where you live, and nothing in these Terms takes away rights you have under those laws. Please email us first. We may update these Terms from time to time. The current version will always be posted on this page, with the "Last updated" date. Changes apply to orders placed after the updated Terms are posted; the Terms in effect when you ordered apply to that order.
